This case stemmed from the US Patent and Trademark Office’s (USPTO’s) refusal to register as trade dress the “Ark” bag design (pictured beneath as depicted in the TTAB opinion) sold under Jasmin Larian’s Los Angeles-based CULT GAIA brand.
