Starbucks successfully fends off a trade-secret lawsuit brought by Balmuccino LLC, a company claiming that the coffee chain stole its trade secrets to create the “S’mores Frappuccino” lip gloss. U.S. District Judge John Chun in Seattle dismissed the case, ruling that Balmuccino waited too long to bring the lawsuit, marking the second time the case has been dismissed on procedural grounds. Balmuccino intends to appeal the ruling and refile the case in New York, stating they won’t stop fighting until the merits of their claims are heard.
